The entire process, under the jurisdiction of the probate court, takes from six to eighteen months depending on the complexity of the estate.<\/p><p>If your loved one died with any asset in their own individual name, and didn\u2019t have a beneficiary (POD) listed on that specific asset, that asset will need to go through Probate Court. Wills alone do not avoid probate court, but Wills always go through probate court.<\/p><p>Probate is the court process used to determine the validity of a Will, oversee the payment of creditors and the distribution of estate assets. Even if there is no valid Will at the time of death, the estate will still go through the probate procedure. There are specific procedures proscribed by each state for carrying out this process.<\/p><p>Probate court requires that you retain an attorney to administer an estate.
